(Atlanta, Ga. – Apr. 30, 2009) Under the terms of a settlement with the U.S. Environmental Protection Agency, Talla Villa Apartments, a Florida Limited Partnership in Tallahassee, must pay a civil penalty of $7,700 for alleged violations of the residential Lead-Based Paint Hazard Reduction Act.  Additionally, Talla Villa Apartments will perform a Supplemental Environmental Project (SEP) valued at more than $69,300.  The SEP includes encapsulating existing lead-based painted components and replacing interior doors and door jambs identified within the Talla Villa Apartment complex.  This SEP is the first of what EPA hopes will be many abatement projects in the southeast aimed at reducing lead hazards to children and families. 

 

The alleged violations include, but are not limited to:

  • Failure to provide the renter with an EPA-approved lead hazard information pamphlet before the renter is obligated under any contract to lease target housing;
  • Failure to include as an attachment to or within the contract, a statement disclosing the presence of known lead-based paint or a statement indicating no knowledge of the presence of lead-based paint; and 
  • Lack of a statement in the lease or contract by the renter affirming receipt of the information. 

Over the last several years, EPA has been working with Federal, State, and local partners to eliminate childhood lead poisoning as a public health threat.  The Talla Villa case represents a new approach by the Region to support the national goal of achieving tangible pollutant reductions through the enforcement of the Residential Lead-Based Paint Hazard Reduction Act and the Lead Disclosure Rule.

 

The Residential Lead-Based Paint Hazard Reduction Act and implementing regulations in the Lead Disclosure Rule help prevent exposure -- especially of children -- to hazards from lead-based paint by requiring disclosure and notification when selling or leasing housing. The Lead Disclosure Rule requires that landlords or sellers of housing

constructed prior to 1978 provide each purchaser or tenant with a lead hazard information pamphlet, any information and/or reports concerning lead-based paint hazards at the property and a Lead Warning Statement to be signed by the parties. Additionally, sellers are required to provide purchasers with an opportunity to conduct a lead-based paint evaluation.

 

Children under six years of age are among the most vulnerable to the harmful effects from lead-based paint and other lead containing materials such as dust and contaminated soil.  Recent studies indicate that almost one million children nationwide have blood-lead levels above safe limits. Lead poisoning in children can have serious, long-term health and quality of life impacts, including intelligence deficiencies, learning disabilities, hearing impairment, hyperactivity and/or behavioral problems.  More than half of the U.S. housing stock built before 1978 may have significant lead-based paint hazards.

Trident Seafoods pays over $112,000 for failing to properly report hazardous chemicals

Company agrees to spend over $51,000 in emergency response equipment for responders in Kodiak and Akutan, Alaska.

(Seattle, Wash. – April 30, 2009) Trident Seafoods Corporation (Trident) has settled with the Environmental Protection Agency (EPA) and agreed to pay a $61,354 penalty for violating the federal Emergency Planning and Community Right-to-Know Act (EPCRA) by failing to properly report the storage of ammonia at four facilities.

Specifically, Trident failed to file Emergency and Hazardous Chemical Inventory Forms with local emergency response entities in Alaska and Washington.

In addition to paying the penalty, Trident agreed to perform a Supplemental Environmental Project, providing over $23,000 in emergency response equipment to first responders in Kodiak, Alaska and over $28,000 in response equipment to responders in Akutan, Alaska.

"People’s safety and preventing chemical accidents are a top priority for EPA," said Edward Kowalski, Director of EPA’s Office of Compliance & Enforcement in Seattle. "We’re committed to reducing the likelihood and severity of accidental chemical releases by enforcing the law, protecting people and the environment and creating a level playing field for industry."

Today’s settlement addresses violations related to Trident facilities in the Alaskan towns of Kodiak, Akutan and Petersburg, as well as a Trident facility in Seattle, Washington, all which store ammonia in amounts above the Emergency Planning and Community Right-to-Know Act reportable quantities. The four Trident facilities process seafood.

 EPA orders Builder’s Aggregate and JJ Concrete to restore South Platte River near Fort Morgan

(Denver, Colo. – April 30, 2009) The U.S. Environmental Protection Agency has issued a compliance order to Builder’s Aggregate and JJ Concrete for violations of the Clean Water Act in Fort Morgan, Colo.  The companies allegedly violated the Act by placing material into the South Platte River and its adjacent wetlands without a permit.  

“These unauthorized actions damaged the ability of the South Platte River and its adjacent wetlands to provide habitat for birds and animals and to reduce the force of flood waters,” said Diane Sipe, Director of EPA Region 8’s Water Enforcement Program.  “EPA is ordering Builder’s Aggregate and JJ Concrete to promptly restore the damage to the river and its wetlands.  We will continue to pursue actions against those who violate federal laws that protect Colorado’s waters.”

The alleged violations occurred in the spring of 2008 when the companies leveled approximately two acres of wetlands adjacent to the South Platte River to expand the area for their sand, gravel and concrete operations.  The companies also stockpiled material in the channel of the river and placed rip rap along the river’s banks.

EPA’s order requires measures to correct the environmental damage resulting from the unauthorized activities.  Builder’s Aggregate and JJ Concrete must remove all material placed in the riverbed and wetlands and restore affected areas to pre-impact conditions and grade.  Materials the company dredged from the river and stockpiled within the channel of the South Platte must be removed within 21 days, in advance of spring runoff.  Prior to beginning the remainder of the work, the companies must submit a plan detailing how removal and restoration will be accomplished.

The South Platte River and wetlands disturbed by the violations provide numerous functions and values, including wildlife habitat for birds, mammals, reptiles and amphibians; water quality enhancement; flood attenuation; and aesthetics.

Permits are required before performing work that results in the disturbance or placement of material into rivers, lakes, streams and wetlands. These alleged violations could have been avoided had Builders Aggregate and JJ Concrete applied for and obtained a permit from the Army Corps of Engineers before working in the South Platte River and its wetlands. EPA Announces $82 million in Recovery Act Funds for Water Projects in Arizona to Boost Economy, Create Jobs and Protect Public Health

 

 In a move that stands to create jobs, boost local economies, improve aging water and wastewater infrastructure and protect human health and the environment, the U.S. Environmental Protection Agency (EPA) has awarded $82 million to the State of Arizona. This new infusion of money provided by the American Recovery and Reinvestment Act of 2009 will help the state and local governments finance many of the overdue improvements to water projects that are essential to protecting public health and the environment across the state.

 

“This remarkable opportunity to provide much-needed support for sustainable water and energy-efficient drinking water and wastewater systems throughout the U.S. is unprecedented,” said Laura Yoshii, acting Regional Administrator for the U.S. Environmental Protection Agency in the Pacific Southwest.  “This funding will allow Arizona to identify its highest infrastructure priorities, protect human health and surface water quality, address climate change, and create critical green jobs as a foundation for a sustainable future.”

 

The Clean Water State Revolving Fund program will receive $26.4 million. It provides low-interest loans for water quality protection projects for wastewater treatment, non-point source pollution control, and watershed and estuary management. The Drinking Water State Revolving Fund program will receive $55.3 million. It provides low-interest loans for drinking water systems to finance infrastructure improvements. The program also emphasizes providing funds to small and disadvantaged communities and to programs that encourage pollution prevention as a tool for ensuring safe drinking water. 

 

EPA is also awarding $267,400 in Recovery Act funds for Water Quality Management Planning (WQMP) in Arizona. Planning is an important step in EPA’s goal to improve water quality in America’s lakes, rivers and streams. WQMP grants support a broad range of activities, such as setting standards, monitoring the quality of the water, developing plans to restore polluted waters, and identifying ways to protect healthy waters from becoming polluted. States are also encouraged to use these funds for more innovative planning activities, such as developing plans to adapt to climate change, analyzing trends in water availability and use, and creating low-impact development programs. Grants are awarded to state agencies and some of the funds can be awarded to regional and interstate planning organizations.

 

An unprecedented $6 billion dollars will be awarded to fund water and wastewater infrastructure projects across the country under the Recovery Act in the form of low-interest loans, principal forgiveness and grants. At least 20% of the funds provided under the Recovery Act are to be used for green infrastructure, water and energy efficiency improvements and other environmentally innovative projects.

 

President Obama signed the American Recovery and Reinvestment Act of 2009 on February 17, 2009, and has directed that the Recovery Act be implemented with unprecedented transparency and accountability. To that end, the American people can see how every dollar is being invested at Recovery.gov.

 In a move that stands to create jobs, boost local economies, improve aging water and wastewater infrastructure and protect human health and the environment, the U.S. Environmental Protection Agency (EPA) has awarded $38.9 million to the State of Nevada.  This new infusion of money provided by the American Recovery and Reinvestment Act of 2009 will help the state and local governments finance many of the overdue improvements to water projects that are essential to protecting public health and the environment across the state.

“We are glad to see these Recovery Act funds become available for Nevada. The funds will be particularly helpful to our rural areas and disadvantaged communities,” said Nevada Division of Environmental Protection Administrator Leo Drozdoff.

U.S. EPA’s ENERGY STAR Program Recognizes Record Number of Energy-Efficient Building Designs

Latest commercial building design projects to be unveiled today in San Francisco

     (San Francisco, Calif. – April 30, 2009) Today the U.S. Environmental Protection Agency will unveil the latest group of commercial building design projects that have been recognized as Designed to Earn the ENERGY STAR.  Together with representatives from the American Institute of Architects (AIA), EPA will recognize 75 new commercial building design projects for their energy efficiency, representing a 60 percent increase in the number of qualifying projects over the last year.

     “By designing buildings to be energy efficient, these architectural and engineering firms are leading the way in the fight against global warming,” said Deborah Jordan, the EPA’s Air Division director for the Pacific Southwest.  “We congratulate this year’s Designed to Earn the ENERGY STAR recipients for their commitment to energy reductions in the built environment.”

     EPA’s Designed to Earn the ENERGY STAR connects the energy design intent of a building with its operating performance, ensuring energy efficiency throughout the building’s life cycle.  Projects that qualify for this designation are designed to create fewer greenhouse gas emissions and save money on energy bills over the lifetime of the building.  Once built, this year’s 75 new projects are estimated to save nearly 100,000 metric tons of greenhouse gas emissions and more than $6 million in energy costs annually across more than 14 million square feet.  On average, these projects are estimated to reduce carbon emissions by 50 percent, which meets AIA’s goal for a 50 percent CO2 reduction on newly constructed buildings by 2010.

     An architecture firm can receive EPA’s Designed to Earn the ENERGY STAR by comparing the project’s intended energy use against the energy use of comparable operating buildings by using EPA’s no-cost online tool, Target Finder. Once built, building owners are then able to benchmark the actual performance of completed projects using another online EPA tool, Portfolio Manager.  In this way, they can verify that the building is operating as intended.

     Since the program’s inception in 2004, nearly 170 building design projects submitted by 84 firms have achieved EPA’s Designed to Earn the ENERGY STAR.  These projects—totaling nearly 28 million square feet of space—were designed to prevent more than 180,000 metric tons of CO 2 emissions per year, a 46% reduction over average similar buildings, and save more than $12 million in annual energy costs.

     ENERGY STAR was introduced by EPA in 1992 as a voluntary, market-based partnership to reduce greenhouse gas emissions through energy efficiency.  In 2008, Americans, with the help of ENERGY STAR, saved about $19 billion on their energy bills while reducing greenhouse gas emissions equivalent to those of 29 million vehicles.
